This notice covers your dental record and other health information we hold, including appointment reminders. How our website collects information is described in our website Privacy Policy.
Your rights
Get an electronic or paper copy of your dental record
You can ask to see or get an electronic or paper copy of your dental record and other health information we have about you, including x-rays. Ask us how to do this. We will give you a copy within 14 days of your written request, as New Jersey rules require (N.J.A.C. 13:30-8.7), or, if you agree in advance, a summary instead of a copy. We may charge a reasonable, cost-based fee for copies. New Jersey caps that fee at $1 per page or $100 for the whole record, whichever is less; if your record is under 10 pages, we may charge up to $10 to cover postage and retrieval. The caps are $15 for a set of up to nine x-rays or $30 for up to 18 x-rays or a panoramic x-ray. We will not charge you for a copy if we are the ones who ended the dentist-patient relationship. To request your record, ask our front desk, call (973) 808-4373, or write to us at the address above.
Ask us to correct your dental record
You can ask us to correct health information about you that you think is incorrect or incomplete. Ask us how to do this. We may say “no” to your request, but we’ll tell you why in writing within 60 days.
Request confidential communications
You can ask us to contact you in a specific way (for example, home, office, or cell phone; call or email) or to send mail to a different address. We will say “yes” to all reasonable requests.
Ordinary email is not encrypted. If you would rather we not use it, tell us and we will call or mail you instead.
Ask us to limit what we use or share
You can ask us not to use or share certain health information for treatment, payment, or our operations. We are not required to agree to your request, and we may say “no” if it could affect your care. If we agree, we may still share this information if you need emergency treatment.
If you pay for a service or item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your dental or health insurer. We will say “yes” unless a law requires us to share that information. To make a request, ask our front desk or write to us at the address above.
Get a list of those with whom we’ve shared information
You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why. We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.
Get a copy of this privacy notice
You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly.
Choose someone to act for you
If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information. We will make sure the person has this authority and can act for you before we take any action. A parent or guardian can usually exercise these rights for a child under 18, except where New Jersey law lets the minor consent to care on their own.
File a complaint if you feel your rights are violated
See Complaints below. We will not retaliate against you for filing a complaint.
Your choices
Tell us what you want us to do and we will follow your instructions. You have both the right and choice to tell us to:
- Share information with your family, close friends, or others involved in your care or in paying for your care
- Share information in a disaster-relief situation
If you are not able to tell us your preference — for example, if you are unconscious — we may share your information if we believe it is in your best interest.
In these cases we will not use or share your health information unless you give us written permission:
- Marketing purposes
- Sale of your information
- Most sharing of psychotherapy notes (we do not keep psychotherapy notes)
Any use of your health information for marketing, and any sale of it, needs your written authorization first. Our appointment confirmations and reminders are about your care and are not marketing. Our website does not use advertising or analytics tools; how the website handles your information is described in our website Privacy Policy.
We do not raise funds using your health information, so you will not receive fundraising communications from us.
Our uses and disclosures
How we typically use or share your health information
- Treat you. We can use your health information and share it with other professionals who are treating you. Example: we send your x-rays and treatment notes to an oral surgeon or endodontist we refer you to, or to the dental lab that makes your crown. Dental labs are health care providers and receive only what they need to make your restoration.
- Run our practice. We can use and share your health information to run our practice, improve your care, and contact you when necessary. Example: we use your chart to schedule your visits and send you appointment confirmations and reminders by phone or email; we review charts for quality and staff training.
- Bill for your services. We can use and share your health information to bill and get payment from health plans or other entities. Example: we send your dental plan the procedure codes and dates of service so it will pay for your care; we may share the minimum needed with a financing partner you choose (CareCredit, Cherry) to process your payment.
How else can we use or share your health information?
We are allowed or required to share your information in other ways — usually in ways that contribute to the public good, such as public health and research. We have to meet many conditions in the law before we can share your information for these purposes.
- Help with public health and safety issues — for example, preventing disease, reporting adverse reactions to medications, helping with product recalls, reporting suspected abuse, neglect or domestic violence, and preventing or reducing a serious threat to anyone’s health or safety.
- Do research — we can use or share your information for health research (only under conditions set by law).
- Comply with the law — we will share information about you if state or federal laws require it, including with the Department of Health and Human Services if it wants to see that we’re complying with federal privacy law.
- Respond to organ and tissue donation requests.
- Work with a medical examiner or funeral director — we can share health information with a coroner, medical examiner or funeral director when a person dies.
- Address workers’ compensation, law enforcement, and other government requests — for workers’ compensation claims; for law enforcement purposes or with a law enforcement official; with health oversight agencies (such as the New Jersey State Board of Dentistry) for activities authorized by law; for special government functions such as military, national security and presidential protective services.
- Respond to lawsuits and legal actions — we can share health information about you in response to a court or administrative order. We can respond to a subpoena, discovery request or other lawful request that is not backed by a court order only after the protections the law requires are met — for example, when you have been notified and had a chance to object, or a protective order is in place.
- People involved in your care — unless you object, we may share information with a family member, friend or other person involved in your care or in paying for your care, and in a disaster-relief situation.
- Business associates — we share information with companies that do work for us (for example, our practice-management software (CareStack) and any billing service we use); they must sign a contract agreeing to protect your information.
Information with extra protection under New Jersey law
Where New Jersey law is stricter than the federal rule, we follow New Jersey law. In particular:
- HIV/AIDS information — we will not disclose records that identify you as having or being tested for HIV or AIDS without your prior written informed consent, except as New Jersey law specifically allows (for example, to the people directly treating you, to the Department of Health as required, or under a court order) (N.J.S.A. 26:5C-7 to 26:5C-9).
- Genetic information — we will not obtain or share your genetic information (for example, genetic test results) without your informed consent, except as New Jersey law specifically allows (N.J.S.A. 10:5-45 and 10:5-47).
- Mental health records — we will not share records from a New Jersey mental-health facility or program that we hold without consent from you (or your parent or guardian if you are a minor), unless a court orders it or New Jersey law specifically allows it (N.J.S.A. 30:4-24.3).
Other uses need your written permission
We will not use or share your information other than as described in this notice unless you tell us we can in writing. If you tell us we can, you may change your mind at any time. Let us know in writing if you change your mind; we will stop, except where we have already acted on your permission.
Once we share your information with someone outside our practice as this notice allows or as you permit, that person may not be covered by federal privacy law and could share it further.
How long we keep your records
We keep your dental record, including x-rays, for at least seven years after the last entry in your record, as New Jersey requires (N.J.A.C. 13:30-8.7).
Our responsibilities
- We are required by law to maintain the privacy and security of your protected health information and to give you this notice of our legal duties and privacy practices.
- If a breach of your unsecured health information occurs, we will notify you as the law requires (within 60 days of discovering it).
- We must follow the duties and privacy practices described in this notice and give you a copy of it.
Changes to the terms of this notice
We can change the terms of this notice, and the changes will apply to all information we have about you. The new notice will be available upon request, posted in our office, and posted on our website at soradentistry.com/sora-privacy-practices.
